Who these terms cover

These terms are an agreement between you and Phantom Inc Pvt Ltd, a private limited company incorporated in Nepal, with its registered office in Kathmandu, Nepal ("we", "us"). They cover your use of the Navapatra API, dashboard, SDKs, widgets, MCP server and this website (together, "the Service").

If you accept these terms on behalf of an organisation, you confirm that you have authority to bind it, and "you" means that organisation.

Accounts and keys

  • Secret keys (sk_live_ and sk_test_) are for servers only. Keep them out of browsers and mobile apps.
  • Publishable keys (pk_) work only from the origins you allow. The Origin header is advisory, so set a credit cap on each publishable key.
  • You are responsible for activity under your keys. Revoke a key as soon as you think it has leaked.

Credits and payment

  • Credits are prepaid in NPR. One successful (2xx) request costs one credit unless the pricing page says otherwise.
  • Paid credits are valid for 12 months from purchase. The monthly free grant does not roll over.
  • Prices exclude 13% VAT, which is added at checkout.
  • Refunds follow the refund policy.

Acceptable use

  • Do not resell raw API access as a competing API without an enterprise licence.
  • Do not try to get around rate limits, credit caps or key restrictions.
  • Do not use the free tools for automated or bulk requests.
  • Do not use the Service for anything unlawful.

Outputs

Computed astronomical positions, astrological values (including charts, dashas, yogas and guna milan or compatibility scores), panchang elements, and Bikram Sambat and Nepal Sambat dates (together, "Outputs") depend on the inputs provided (birth date, time, place and time zone) and on the conventions selected or our documented defaults (for example ayanamsha and node type).

Different traditions, almanacs (patros and panchangs), astrologers and official bodies may reach different results. Dates marked "projected" may differ from those later published by the Nepal Panchang Nirnayak Samiti or announced by the Government of Nepal or the Government of India.

Outputs are for informational and cultural purposes only. They are not predictions of future events, and they are not medical, psychological, legal, financial, matrimonial or other professional advice. They must not be the sole basis for any such decision.

Disclaimer of warranties

Except as expressly stated in these terms, the Service and Outputs are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that Outputs will match any particular almanac, astrologer, government calendar or other source, or that the Service will be uninterrupted or error-free.

The tolerances on our accuracy page describe how we test each release. They are not a warranty, except as provided under "Reporting wrong results".

Your end users

You are responsible for how you present Outputs. Wherever you show Outputs to your end users, you must:

  • (a) show a notice at least as protective as this one: "Astrological and calendar results are for informational and cultural purposes only and are not professional advice. Dates may differ from official announcements.";
  • (b) not present Outputs as guaranteed, scientifically validated, or endorsed by us or by any government; and
  • (c) not use our name or marks to suggest that we endorse you or your product, unless we have agreed in writing.

Reporting wrong results

If you believe an Output is wrong, email accuracy@navapatra.com within 30 days of the request. Include the x-request-id, the full request, the meta block of the response and the value you expected.

A "Defect" is an Output that is outside the published tolerances for the engine and data versions shown in meta, or a Bikram Sambat date marked "published" that differs from the calendar of the Nepal Panchang Nirnayak Samiti.

The following are not Defects: differences caused by the inputs; results that follow from conventions you selected or from our documented defaults; values within the published tolerance of a boundary (for example a sign, nakshatra or tithi boundary); dates marked "projected"; and later revisions by an official body.

If we confirm a Defect, we will:

  • use reasonable efforts to correct it, normally within 7 days, and list the correction in the changelog; and
  • return the credits charged for the affected requests, identified from our usage records for the affected endpoint and period, or as you reasonably demonstrate. Returned credits are valid for 12 months, have no cash value and are not refundable.

If we do not correct a confirmed Defect within 30 days, you may close your account and receive a pro-rata refund of your unexpired paid credits.

Corrections apply to new requests only. The engine is at version 0.x, and Outputs may change between releases within the published tolerances.

This section is your sole and exclusive remedy, and our entire liability, for Defects and inaccurate Outputs.

Availability and changes

API versions are dated and pinned per organisation, and breaking changes get at least 12 months of notice. Data corrections (timezones, the BS table, Samiti overrides, holidays) apply to every version.

Service level

This section applies only to Annual Business and Enterprise plans.

  • Monthly uptime of the API will be at least 99.9%. Uptime excludes scheduled maintenance announced at least 48 hours in advance and unavailability caused by events outside our reasonable control.
  • If monthly uptime falls below 99.9%, you receive a service credit of 10% of the plan fee prorated for that month. Below 99.0%, the credit is 25%.
  • To claim a credit, email hello@navapatra.com within 30 days after the end of the affected month.
  • Service credits are your sole and exclusive remedy for unavailability of the Service.

Limitation of liability

  • (a) Neither party is liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, anticipated savings or data.
  • (b) Each party's total liability arising out of or in connection with these terms is limited to the greater of the fees you paid us in the 12 months before the event giving rise to the claim and NPR 10,000.
  • (c) These limits do not apply to your obligation to pay fees, to your liability for breach of "Acceptable use" or under "Indemnity", to fraud, wilful misconduct or gross negligence, or to any liability that cannot be limited by law.
  • (d) Credits under "Reporting wrong results" and service credits under "Service level" are the sole remedies for the matters they cover.

Indemnity

You will defend and indemnify us against any third-party claim, including a claim by your end users, arising from your products or services, your presentation of Outputs, your breach of "Your end users" or "Acceptable use", or your failure to comply with data protection law for the data you send to the Service.

Ending the agreement

You can close your account at any time from the dashboard. We may suspend keys that break these terms, and will tell you why.

Changes to these terms

We will give at least 30 days of notice by email before a material change to these terms takes effect. If you keep using the Service after that date, you accept the changed terms.

Governing law and disputes

  • These terms are governed by the laws of Nepal.
  • If a dispute arises, both parties will first try in good faith to resolve it by negotiation for 30 days. If it is not resolved, it will be settled by arbitration under the Arbitration Act, 2055 (1999) of Nepal, seated in Kathmandu, before a sole arbitrator, in English.
  • Subject to the arbitration clause, the courts of Kathmandu have jurisdiction.
  • Either party may seek urgent injunctive relief in any court of competent jurisdiction.
  • The English version of these terms prevails over any translation.
